Apa itu "Perfection of Transfer" & "Perfection of Charge"?
 
Ada yang bertanya tentang ini dan di sini saya kongsikan jawapan ringkas saya:-
Ini adalah situasi bila pembelian rumah/ hartanah dibuat sebelum ada Strata/ Hakmilik Individu.
 
Contoh:
Kalau kita beli hartanah dari pemaju , apa perlu dibuat bila selepas beberapa tahun kita beli tu, Strata/ Hakmilik Individu dikeluarkan oleh pejabat tanah atas nama pemaju?
 
Perkara yang perlu dibuat:-
  1. Penyempurnaan pindah milik (Perfection of Transfer) antara pemaju dan pembeli/ tuanpunya terkini dengan menandatangani borang pindahmilik (Form 14A).
  2. Penyempurnaan Gadaian (Perfection of Charge) antara pemilik terkini dan pihak bank jika loan masih ada, dengan menandatangani borang gadaian. Sebagai peminjam, kita tertakluk dengan perjanjian asal kita dengan pihak bank iaitu kalau geran dah keluar, kita kena pastikan gadaian kepada pihak bank didaftarkan di pejabat Tanah.
 
Nota:
Apabila membeli hartanah yang belum mempunyai geran/ masih dibawah hakmilik induk (master title), PEMBELI mesti tahu kronologi pembelian dan penjualan hartanah tersebut dari pembeli pertama hingga terkini DAN hendaklah simpan semua dokumen seperti SPA, Deed of Assignment, Deed of Receipt & Reassignment, Power of Attorney dan juga Revocation of Power of Attorney KERANA IANYA PENTING utk pastikan penyempurnaan pindah milik & gadaian (perfection of transfer & perfection of charge) dibuat dengan pihak yang betul.
 
Saya tak sentuh soal kos dan prosedur kerana ia bergantung kepada beberapa faktor seperti harga belian rumah/ sekatan atas tanah/ lokasi tanah.
 
Info ini hanyalah sebagai garis panduan. Harap sedikit sebanyak membantu tuan-tuan & puan-puan.

  3. how if we as buyer refuse to proceed for perfection? coz involve a large sum of money (mot & moc). do lawyer has the right to instruct our bank to debit our account?any written agreement allow lawyer to do so?

  4. hai Sandy . Yes the bank has the right to execute the documents and advance the fees and charges to the borrower in accordance with the powers of Power of Attorney & Loan Agreement (signed by the borrower)

    1. Hai Lc, actually i receive the letter from lawyer and remind me that complete the perfection of transfer and charge within one year, i received the letter last year July, i am not sure i will get any penalty if i do not do it

    Q: how if we as buyer refuse to proceed for perfection?
    A:
    i.you can be penalized under the respective law. Please read the notice issued by the developer.

    ii. If you are still serving loan for the house, your financier will exercise their rights in accordance to the agreements you have entered with them. You have to remember, when you obtained the housing loan, you have agreed that once the title is issued, you will have to register at the land office that the house is charged to your financier. If you refuse to do the perfection, that wil jeopardize the bank's interest. 1 of the loan documents is Power of Attorney (POA). With that POA, your financier can exercise their rights to do the perfection of transfer and the perfection of charge on your behalf.

    Q: do lawyer has the right to instruct our bank to debit our account?
    A: when the bank/ financier take over the perfection of transfer and the perfection of charge, they will appoint lawyer to do the works. They will pay the lawyer and thereafter charge the sum on the borrower.

    Q:any written agreement allow lawyer to do so?
    Please refer to your agreements with the bank.
